It sounds like this bug report can be closed, and the patch should be
submitted for 2.6.30.stable.

I assume whomever submits the patch will close this bug.

If anyone cares, the other bug I found chasing this one was in was actually in hal:

Turns out some kind of event ordering race with processing the udev events vs. sysfs availability.
