Under the link mentioned above there is a scrollable area under the heading
"Please read the license agreement before continuing".
In the said "license agreement" there is Section 2, "GRANT OF LICENSE",
where letter (b) reads:

"Patent license.  Microsoft hereby grants to You a nonexclusive,
royalty-free, nontransferable, worldwide license under Microsoft’s
patents embodied solely within the Specification and that are owned
or licensable by Microsoft to make, use, import, offer to sell,
sell and distribute directly or indirectly to Your Licensees
Your Implementation. You may sublicense this patent license
to Your Licensees under the same terms and conditions."

I am not a native speaker nor a lawyer, but it seems to me that
they do grant a royalty-free license to their patents used in the
specification, for the purpose of (among others) making
"Our Implementation" and distributing it to "Our Licensees".
And "We" do have "Our Licensees", who are anyone using Linux -
anyone using Linux agrees to the GPL.
