Indeed

Instead of a special license, they might just include an explicit exception
in there for sapi and directx perhaps.

Yes, just ask them, and they'll probably be fine.  Remember that the author
has all rights concerning the piece of software he wrote, including
providing you a special non-GPL licence for his software.

But on the original issue, no definite answer can be given, except in
trials, since it all depends on the thinking of people.
