At this point, there is no unlocking-restore for spin_lock_irqsave
done at the entry of this function

I think you are just trying to disable interrupts and disable
preemtion - with spin_lock_irqsave/spin_unlock_irqsave
if you are looking to acquire lock - then may be
spin_lock_irq/spin_unlock_irq - will work.
