Isn't the whole point of dual BSD/GPL that it makes it possible to make the driver BSD only/GPL only later on? Pure BSD code (w/o advertising clause) can have additional restrictions (GPL or some proprietary licensing terms) added later on by a vendor, so why can't BSD/GPL code be relicensed the same way? If it's polite to relicense the code is a completely different question.
