[PATCH 2.6.13-rc6] remove 2.4 compat code from cpqfcTS driver, take 3

Remove compat code for Linux 2.4 and earlier.
Version 2: Fixed bug in earlier version that caused compile error.
Version 3: found bug in previous patch, changed this to apply cleanly.
