IMHO the university needs to grant a global, free license to this patent, effectively dropping all claims it has. For example you can restrict this to Linux Kernel use, because the GPL is more open. It might be enough to publish the code under the GPL to do that, however in that case the license holder has to autorise it. In that case the best thing is to hand it over to the FSF or someone similiar, see the GPL FAQ.
