e100 problem

I triggered problem today with e100 driver. Kernel is 2.4.20 with 
security patches. There were many lines in kern.log:

eth0 e100_wait_exec_cmd: Wait failed.
eth1 e100_wait_exec_cmd: Wait failed.

There was quite heavy unusual traffic through this box. After removing 
cause of this traffic and reset all goes normal again.

I found this problem reported before:

But I can't find any reference if this is fixed already in newer (for 
example 2.4.22) kernels. Is it?
