Hmm. There are two cases here:

        if (start != vma->vm_start) {
                ...
                error = __split_vma(mm, vma, start, 1);
        }

and

        if (end != vma->vm_end) {
                ...
                error = __split_vma(mm, vma, end, 0);
        }

so, I don't think such a comment would be completely correct, no?
