Because the removing flag is set, xs_fastpath_fop_open() won't do anything but increment the file_count, then decrement it again, and call wake_up(). That all works with xs_fastpath_dev as a static variable. But it might not work if xs_fastpath_dev was dynamically allocated, as would be the case if multiple such devices were supported. So I'm wondering if this code really should do the misc_deregister() and debugfs_remove_recursive() first, and then to the wait_event(). When done in that order, you know that the device can't be found again after the wait_event() completes.
