Because the previous hunk in the patch:

	+	if (!PageUptodate(page)) {
	+		if (copied < len) {
	+			copied = 0;
	+			goto out;
	+		}
	+
	+		SetPageUptodate(page);
	+	}

means you can't get there unless PageUptodate() is true by that point.
