In my experience lockdep has never complained about acquiring a lock, where
it had never been acquired, so I would rather take the complaint seriously.
However, a false possitive can be if the same lock acquired for another object.
I have swap as a file on a different ext3 partition.

It seems to be somehow related. 2.6.29 works just fine.
