Shouldn't we also just delete the driver?
Well, I guess that's up to you. The package that the firmware files live
in is still available from Digi's site I suspect. Plus that recent
patch to linux-firmware does contain them and that is public record. So
I suspect the driver could still be used by anyone that had the cards
and found the firmware files. Again, up to you sir.

Agreed. I see no "real" issue with the firmware going in tree. We
have/had been redistributing/re-packaging that Digi package for years. I
never actually thought the firmware would be a problem because the whole
package is GPL. But if that's their policy, nothing I can do. I tried.
