As the issue happens during S3 or S2Idle, if there is active scanning, I think
that can only be done by the controller.

No, the device that sends the advertising packets has not been added to these
lists.

If I understand you correctly, do you mean waking up from seeing a device that
is in the list during passive scanning is still a controller bug?
