There is almost definitely a bug in this area, but no one has been able
to reliably reproduce it.  The issue is something like "clients don't
always get SCHED_FIFO with certain NPTL versions".

This was never too much of a problem because with 2.6 the latency wasn't
good enough anyway.  Now that the 2.6 latency issues are resolved, it
would be very useful to track this bug down.
