For upstream it's possible to patch for atm overheads so you can in theory go really close to the limit. If you can't get the overheads right how much you have to back off from rate depends on your traffic pattern wrt packet sizes. If you have lots of small packets you will need to back off more than if most traffic is bulk.
For ingress, it depends more on how much you care about latency. Shaping from the wrong end of the bottleneck is not nice. You may need to sacrifice 20 - 50 % depending on latency requirements and traffic type - lots of connections/bittorrent etc being harder to shape than a few.
