No, it's not. The Supreme Court has ruled on it. Local jurisdictions that pass laws in contradiction to the recognizing the full legal rights of same-sex couples and their families are being slapped around by higher courts. Socially there are still issues, but legally, same-sex family legal rights are settled in the US, as they are in Canada and in many European countries.
