I don't think RFC 5378 requires the Contributor personally to get the rights. The Contributor instead is just asserting that any other party that may have rights in the Contribution is also willing to agree to the same terms: The Contributor is further deemed to have agreed that he/she has obtained the necessary permissions to enter into such an agreement from any party that the Contributor reasonably and personally knows may have rights in the Contribution, including, but not limited to, the Contributor's sponsor or employer. If the other party has explicitly grantd such rights to the Trust, then it seems to me the Contributor can assert that the necessary permissions have been obtained.
