It says: "Permission to modify the software is granted, but not the right to distribute the modified code. Modifications are to be distributed as patches to released version." But, it is rather obvious that the XQuilla upstream modified that code (#include <xqilla/framework/XQillaExport.hpp>) and is distributing the modified software, not as a patch to the released version.
