The only way the "but" part can be enforced in RPM is by not using /opt at
all. RPM *will* overwrite files installed by the admin outside of RPM if
they conflict with a file in an RPM.

Must RPM really enforce it? RPM allows to do many nasty things, but
packagers don't do them. Why? Because they more or less follow the
guidelines, which should be enough in this case. If guidelines contain
some rational rules (e.g. there is a <provider> capability), I don't see
a problem.
