I can't speak for Europe, but in the US Constitution it's fairly clearly stated: "The Congress shall have Power ... To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries" In the case of software the implementation of the law may be problematic, but still, as an author and inventor I'd want those rights.
