This makes it effectively impossible to use the device unless you have a
closed-source userspace application to configure it, isn't it ?

Firmware that runs on a device can be shipped as a binary blob, but
configuration of the device must not require closed-source software. To
be upstreamed, a driver needs to be usable either on its own (with its
userspace APIs document and usable by all applications), or in
combination with an open-source userspace stack.
