Yes, there is a small bug here in the sense that Apache tries to prevent you from shooting yourself in the foot by only trying to include text/* documents but allows you to dodge that check using encoding and shot yourself in the foot anyway. But that is really only a safety check, and the fix is either not gzip your README, or configure apache not to include it. (In other words, stop trying to shoot yourself in the foot.) I think it is borderline whether it is worth adding code to check for this special case.
