Pratically, the pid number in the httpd.pid file, is not updated. Any idea?

Hi,
after the update from apache 2.4.3 to 2.4.4, when perform the gracaful after short time
receive the message:
httpd not running, trying to start
(98)Address already in use: AH00072: make_sock: could not bind to address 0.0.0.0:80
but apache, running without problems:
httpd
pid:
3013 3014 3067 3107 3433 5303 13531
is running...
any idea?
