How about putting this into src/conf/domain_conf.c - this same logic is 
needed for LXC and  UML drivers too. 

Something like

    virDomainObjIsDuplicate(virDomainObjListPtr doms,
                            virDomainDefPtr def,
                            unsigned int check_active);
