Ubuntu (and Debian) "get away with it" because their U.S. servers do not offer software the US government deems illegal as that has legal implications for their project and developers. However, those in the US can configure their apt-sources to download from servers outside of the U.S. That, however, possibly puts the individual in a less than desirable position.
