Defined by politicians and interpreted by the courts. Thus what dictates the content of Fedora and what can lawfully be shipped is the law, which is defined by the politicial process. The Fedora Project can only ship those items which it is permitted in law to ship. That means it must respect trademark, copyright and patent law in the countries in which it is based and operates. Nor can the Fedora project change the licences in software it ships - almost without exception it is not the copyright holder of the components in question.
