That depends entirely on your point of view.
It can be argued that Nvidia is pirating the work of the Linux kernel
developers when creating their closed-source driver for Linux systems.
Before you make that argument, could you explain why you want to make
it? That is, why do Linux developers hate the users who would benefit
from this combination and want to drive them into Microsoft's arms?
Then, even if you do make it, you'll have to establish why this isn't
ordinary fair use of an interface required to interoperate with the kernel.
