That's a matter for the courts and I have no inside knowledge with which
to judge.  Apparently many people say the evidence isn't very compelling,
but who knows.

Yes, they've had to be more "honest" in the sense of feeling competitive
pressure that encourages them in directions they wouldn't otherwise
pursue.
