IANAL, but I do talk with lawyers a lot. It's my understanding that the patents granted to OIN by Novell still belong to OIN, and all of the signatories are still bound to defend technologies covered by OIN. Of which Mono is one.

Mono got into Core on the promise of OIN, so fundamentally we need a
statement from OIN.  Unless OIN is undone, we shouldn't revisit this
