Patch looks good, note this is only a flag in the parted worldview, in the actual msdos partition table it becomes a different partition type then ext# (0x82 vx 0x83), so nothing mkswap can do here. Also note mkswap does not care much about what to format as swap it will also happily format a file as swap, and it gets passed the partition, not the whole device, so there really is nothing mkswap can do here.
